TERMS & CONDITIONS - I SPEAK MAGICK
Agreement between The Purchaser, also referred to as The Client and Stephanie Lianos, also referred to as The Business or The Facilitator.
THE SERVICES:
1. I SPEAK MAGICK - 6 WEEK PROGRAM DELIVERED VIA KAJABI
CONFIDENTIALITY:
1. All information provided by the purchaser to the Facilitator is kept strictly confidential as per the Privacy and Personal Information Protection Act 1998.
2. Any information discussed or any information either party comes to know or possess during the term of this Agreement, including without limitation any information contained in materials provided by the Facilitator to purchaser through the term of this Agreement including but not limited to documents, the resource library, images, audio, and video (the “Materials”), is confidential (the “Confidential Material”).
3. Confidential Material does not include information that either party was aware of prior to executing this Agreement, nor does it include information that was provided to either party by a third party, or information that was available to the public through no breach of confidentiality by the Company. Confidential Information may be shared if and only if waived by both parties in writing. Both parties agree to safeguard the Confidential Information using commercially reasonable means. The terms of this paragraph shall survive the termination of this Agreement indefinitely.
NON-DISPARGEMENT
Both parties agree to not take any actions, make any statements, whether oral or in writing, that negatively impact the other party’s business, services, products, or reputation.
NO GUARNTY; DISCLAIMER
1. NO GUARENTEES;
Results of the Services may vary and are based on the individual.
The Business makes no guarantees regarding the facilitator or the Services.
The facilitator is not an medical professional, psychologist, psychiatrist, attorney, doctor, public relations or business manager, financial analyst, psychotherapist, tax advisor or accountant, nor does the Facilitator hold any license to provide these services to Client.
Client agrees that any statements made by the Company or facilitator, whether orally or in writing, including without limitation the expected development of Client’s financial performance, other client testimonials, or expected personal outcomes for Client, are speculative projections and are not binding on the Company. Any losses incurred by Client following the Effective Date are the responsibility of Client alone.
2. NOT MEDICAL ADVICE
The services are not a substitute for professional medical or mental health services, nor are the services professional therapy, medical advice or any medical or psychological treatment of any kind. The Services are not intended to treat, diagnose, cure, or prevent any physical or mental disease. The Business disclaims any obligation to provide client with medical and/or psychological treatment.
The purchaser of these services understands that these services are not offered as a substitute for clinical mental health care or medical care and are not intended to diagnose, treat or cure any mental health or medical conditions. They also understand that the facilitator is not acting as a medical or mental health professional. Clients will understand and agree that they are fully responsible for their own well-being during whilst undertaking this course and subsequently, including their choices and decisions as a result of doing this process. The facilitator or business holds no responsibility for any decisions, losses or hardships before during or after this purchase.
3.EARNINGS DISCLAIMER
Any information provided by the business or facilitator regarding wealth, abundance, income, earnings, business profits or personal financial status is for informational purposes only.
Client understands that neither the Business nor Facilitator shall seek to procure or attempt to procure or provide, without limitation, employment, sales, or financial advice to Client.
4. REFERRAL
The Facilitator Stephanie Lianos may refer the purchaser to another practitioner if they exhibit physical & mental issues which are outside the scope of practise. The purchaser is aware that they may need to consult other practitioners in the case of any physical or mental ailments, dis-ease, or discomfort.
5. THE HEALING PROCESS
The client understands they play an active role in their own healing. Healing can sometimes be cyclical rather than linear and may get worse before it gets better.
These sessions are for the body’s underlying energetic system, the content is to support personal growth and spiritual development.
The techniques performed in the The Breakthrough are of a complementary health program and do not diagnose conditions or diseases, nor does it replace the care of the clients’ general practitioner. The client understands that this program does not replace the care of a psychologist or psychiatrist.
Client is solely responsible for creating and implementing his/her own physical, mental and emotional well-being, decisions, choices, actions and results arising out of or resulting from the The Breakthrough. As such, the Client agrees that the facilitator Stephanie Lianos is not and will not be liable or responsible for any sickness, emotional turbulence, actions or inaction, or for any direct or indirect result of any services provided by the service.
The purchaser will also understand that all comments and ideas offered by the facilitator are solely for the purpose of aiding the client in achieving their defined goals or to improve or enhance their mental well being or mental maintenance.
The purchaser acknowledges that personal development is a comprehensive process that may involve different areas of his or her life, including work, finances, health, relationships, education and recreation. The purchaser agrees that deciding how to handle these issues, incorporate coaching principles into those areas and implementing choices is exclusively their responsibility.
6. LIMITED LIABILITY
The amount of liability recoverable for any cause of action that arises under this agreement shall not exceed the total payment amount, regardless of whether the cause of action is based in tort, contract, or any other theory of liability. Under no circumstances will the Facilitator or The Business be liable for special, incidental, indirect, or consequential damages of any kind, or for any loss of use, business interruption, costs of procurement of substitute goods or services, lost income, employment or profits or client, or lost data even if the client has been advised of the possibility of such damages.
